In 1995, Mr. Fleming began practicing commercial litigation, construction law and banking law in his hometown of Brownsville, Texas. Since relocating to San Antonio in 1998, Mr. Fleming has represented a wide array of public and private clients across South and Central Texas in litigation involving complex commercial disputes, eminent domain, municipal governance, real estate, public utilities, creditors rights and personal injury defense.
Mr. Fleming has served as lead litigation counsel for public utilities such as CPS Energy of San Antonio, San Antonio Water System and Brownsville Public Utilities Board; Texas municipalities such as the City of San Antonio, the City of New Braunfels and the City of Brownsville; as well as national and local financial institutions, insureds and insurance carriers, construction contractors and subcontractors, homeowners and HOAs, employers and employees, and countless individuals.
TRANSPORTATION LAW
• Successfully defended numerous commercial trucking companies, drivers and carriers in litigation across South and Central Texas
CONSTRUCTION LAW
• Litigation counsel for General Contractors and Subcontractors in disputes with public and private entities arising out of allegations of construction defects
• Litigation Counsel for Private and Public Owners in disputes with contractors and subcontractors arising out of failure to perform and related lien claims
EMINENT DOMAIN
• Lead Counsel in over fifty condemnation proceedings on behalf of various public utilities and municipalities and utilities including CPS Energy of San Antonio and the City of New Braunfels
MUNICIPAL LAW
•Lead Counsel in the successful defense of the City of San Antonio at trial and on appeal regarding the City’s enforcement of real estate development regulations for the benefit of its citizens
LABOR/EMPLOYMENT LITIGATION
• Successfully litigated or resolved numerous employment related issues including non-compete agreements on behalf of both employers and employees
BUSINESS/COMMERCIAL LITIGATION
• Counsel for business interests, both large and small, in the prosecution and defense of a vast range and number of claims and disputes all over South and Central Texas
• Represented numerous national lenders in litigation and collection matters across the State of Texas
