Amy Mitchell

Amy Mitchell has been practicing law for almost four decades and enjoys the prestigious AV rating by Martindale-Hubbell’s Peer Review Ratings. She brings a broad perspective to litigation, having previously worked directly for insurance carriers, such as Nationwide, AIG, Farmers Insurance, Liberty Mutual and USAA where she has represented both the carriers directly and their insureds. Amy has also previously worked for a number of well-known mid-sized litigation firms in the Houston area.

During her 37 year tenure as an attorney, Amy has handled over 3000 litigation cases of varying complexity from inception to conclusion. Her wide caseload includes a large number of complex litigation matters, including class actions, multi party death cases and appeals. Her experience has included trying over 80 cases to conclusion, handling 500+ mediations, and 15-20 arbitrations. Amy has been certified as an arbitrator by both the American Arbitration Association and FINRA (Securities arbitrations). She has extensive experience in all aspects of civil, personal injury and commercial litigation.
Amy’s successful litigation track-record also extends to shareholder disputes where she has handled a number of cases involving issues of minority shareholder oppression and breach of fiduciary duty. In 2013, she obtained a judgment on behalf of her client in excess of $1 Million Dollars after a 5 week trial on a hotly contested shareholder dispute. Her main priority in practice is to work towards a quick, reasonable and efficient resolution of cases directly with the clients and opposing parties.

Amy earned her law degree from the Case Western Reserve and a Bachelors degree in Literature from S.U.N.Y.- Oneonta. She is licensed to practice in all Texas State courts, the Federal Courts of the Southern District, Northern, Western and Eastern District of Texas. She has practiced before the courts in many counties in Texas and before the state courts of appeals in both Houston and Fort Worth. Amy has practiced in every federal district in Texas.
Among Amy’s many interests, she enjoys raising the level of professionalism in the legal community. She is an active member of the Garland walker Inns of Court. She has previously helped plan and conduct seminars on Immigration Law and Fee agreements which were presented to over 100 lawyers and judges. She served on the 5A Grievance Committee of the State Bar of Texas from 2001 through 2007 and was the chair of the committee from 2003 through 2005. Amy also has volunteered her time teaching litigation skills and judging at advocacy competitions in Houston.

Amy is also very active in the community and performs a significant amount of community service in Fort Bend County. In 2011, she was elected to Sugar Land City Council in a publicized runoff. She is a member of the Central Fort Bend Chamber Alliance (Formerly Rosenberg Richmond Area Chamber of Commerce) since 1999, where she served several terms as a Director and is a Graduate of the Fort Bend Leadership Class of 2002. She has also been a member of the Fort Bend Chamber of Commerce since 1999. She served on the 5A Grievance Committee of the State Bar of Texas from 2001 through 2007 and was the Chair of the committee from 2003 through 2005. She has been a member of the Exchange of Sugar Land since 1999 where she has served as President for the 2010-2011 year and on its Board of Directors. Amy also served on the Board of the Escape Center from 2006 through 2010. She has participated in Sugar Land 101, the Sugar Land Citizens Police Academy, the Sugar Land Citizens Fire Academy and CAST. She has chaired numerous community events including the Groovy Party for Fort Bend Seniors Meals on Wheels and Wine and Music for Literacy as well as helped raised hundreds of thousands of dollars towards the prevention of child abuse, to fighting domestic abuse, to fighting illiteracy, and to providing toys to underprivileged children for Christmas.

Amy was born in Brooklyn, New York. She has lived in Texas since 1985 and in Fort Bend since 1993. Amy is married to Gordon Berkstresser.
