Kyle Rowley, George Caflisch and Mary London Fuller obtain Dismissal of Products Liability case in Eastern District of Missouri

Kyle Rowley, George Caflisch and Mary London Fuller successfully asserted a Motion to Dismiss for Lack of Personal Jurisdiction of a national construction equipment manufacturer in a case pending in the U.S. District Court of the Eastern District of Missouri. On June 19, 2018, the District Court ruled, as the Defendant argued, that despite the occurrence of the underlying accident in Missouri, specific jurisdiction over the manufacturer was lacking because of insufficient minimum contacts with the State of Missouri, and dismissed the case. Attorneys at Sheehy, Ware & Pappas have been aggressively asserting jurisdictional challenges for their manufacturing clients in the aftermath of recent U.S. Supreme Court decisions addressing jurisdictional issues.
