Attorney R. Javier Guerra Secures a Trial Victory

Pappas Grubbs Price PC, P.C. attorney, R. Javier Guerra, secured a trial victory On May 8, 2023. 

Guerra represented the defendant, an insured of Sea Harbor Insurance whom the lawsuit was filed against by Thomas J. Henry’s office. The incident was a minor rear end collision during rush hour traffic on Loop 410 in San Antonio, allegedly causing 4 herniated discs. In response, Dr. Stephen Earle, the treating physician, recommended over $700,000 in future surgery be performed. 

TJH’s office ultimately asked the jury to award over $2,500,000 total in past/future meds, past/future pain and suffering, past/future physical impairment and past/future mental anguish. Counsel for the Defendant advised the jury that the plaintiff had not proven any damages during the case in chief. They also advised to, at most, award $18,500 in past meds and perhaps another $10,000 in past pain/suffering.  

After about 2 hours of deliberation, the jury decided to award the plaintiff a total verdict of only $18,000 in past meds, no other damages included.

The case was tried before the Honorable Judge Cynthia Marie Chapa, 288th District Court, Bexar County, TX.
