Mr. McMath is a member of the firm's Toxic Tort and Mass Litigation section.  He has substantial experience representing clients in asbestos and silica litigation involving hundreds of claimants.  He also represents clients in products liability personal injury cases and has worked on commercial litigation matters throughout his career.  With six years of practical oilfield related experience prior to law school, Mr. McMath has an extensive understanding of the day to day exposures and working conditions encountered in the Gulf Coast area refineries with regard to toxic tort claims for asbestos, silica, benzene and welding.  Mr. McMath has first and second chair trial experience and regularly represents national and international manufacturers and suppliers against claims for personal injuries and economic loss.

Representative Experience

Toxic Tort:

  • Representation of a respiratory protection defendant, Louis M. Gerson,  as National Coordinating Counsel and Texas trial counsel in silica, asbestos and chemical exposure claims.
  • Representation of an equipment defendant against silicosis claims throughout the State of Texas.
  • Representation of a silica supplier, Lone Star Industries,  against silicosis claims throughout the state of Texas.
  • Representation of a manufacturer, supplier and distributor of silica and sandblasting equipment.
  • Successfully defended a wallpaper manufacturer against benzene exposure claims.
  • Representation of Mount Vernon Mills, Inc. in claims involving alleged asbestos exposure in paper mills.

 Product Liability:

  • Successfully defended a bicycle manufacturer against claims regarding design, manufacture and marketing defects.

Commercial Litigation:

  • Successfully represented a doctors group in litigation regarding a partnership agreement.
  • Successfully represented a heating and air conditioning contractor in payment dispute arising out of work on a large commercial project.
