Mr. Bayko was admitted to the Texas Bar in 1999 and the New York Bar in 2004.  Prior to joining the firm, Keith was associated with Jones Day in its Dallas and New York offices.  There, he garnered significant experience in representing international oil and gas companies, oil field service companies and national banks in complex commercial litigation in state and federal courts and before domestic and international arbitration panels.  Keith's work focused on matters involving breach of contract, tortious interference, fraud, unjust enrichment, personal injury, mass torts and products liability.   In 2009 and 2010, Keith was named as a "Texas Rising Star," a select group of attorneys chosen by Texas Super Lawyers, Law & Politics magazine, and the publishers of Texas Monthly.
 
 

Representative Experience

  • Successfully defended on summary judgment a $26 million lawsuit against one of the largest United States banks and its Cayman Island affiliate by investors who alleged their investments suffered losses by the bank's actions and inactions.
  • Successfully defended on summary judgment a multi-million dollar lawsuit against a Dutch entity by a national pharmaceutical entity that alleged patent services were not provided as required by contract.
  • Participated in the successful defense of one of the largest oil and gas companies in a $46.4 million international arbitration where it paid no damages and recovered attorneys' fees.
  • Participated in the successful defense of oil field equipment manufacturers sued for $300 million under the Texas Deceptive Trade Practices Act regarding the sale of its equipment for incorporation into three offshore drilling rigs; the client paid no damages.
  • Participated in the successful prosecution of construction claims for a subsidiary of one of the largest oil and gas companies, an international engineering and construction firm, against a Nigerian subsidiary of a major integrated energy company, resulting in a multi-million dollar settlement for the client.
  • Participated in the successful prosecution of claims for an international oil and gas exploration and production company in an international arbitration and helped obtain an award for the client declaring the adverse party to be in default of a joint operation agreement and related agreements, declaring that the adverse party had forfeited all of its participating interest in a block in Yemen and ordering the adverse party to assign its interest to the client, declaring that the adverse party had to pay client all outstanding cash calls and other damages to the client.
  •  Successfully represented respiratory equipment manufacturers in numerous lawsuits filed by individuals alleging silicosis because of product defect.
  • Successfully represented a boiler manufacturer in numerous lawsuits filed by individuals alleging mesothelioma.
